Overview

Brian is a partner in the Indianapolis Office, focusing his practice on defending health care providers and hospital systems.  His experience spans all phases of litigation, having handled matters at their inception during pre-suit negotiations, through trial, and on appeal up to the Indiana Supreme Court. 

Brian began his career with the Office of the Attorney General (OAG), which provided invaluable mentorship from seasoned government litigators and the opportunity to manage a caseload in state and federal court.  Among other responsibilities with the OAG, he was legal counsel to both the Indiana Medical Board and Indiana Board of Veterinary Medicine.  Before joining Reminger, Brian was a partner at a regional firm of over 150 attorneys. 

Representative Experience

  • Lead defense counsel in complex litigation involving Medicaid payment dispute of approximately half a million dollars.  Case involved numerous depositions and tens of thousands of pages of trial evidence.  After 6-day federal preliminary injunction trial, obtained successful result requiring no payment by the State.
  • Lead counsel in medical malpractice trial, obtaining defense verdict after the medical review panel unanimously determined that the defendant breached the standard of care. 
  • Argued before the Indiana Supreme Court on issues related to the scope of the Indiana Medical Malpractice Act, obtaining a result that saved the client hundreds of thousands of dollars.
  • Obtained summary judgment for hospital system on HIPAA privacy breach claims, successfully defended on appeal and petition to transfer to the Indiana Supreme Court.
  • Lead counsel on numerous bench and small claims trials involving the State and state agencies.
  • Successfully represented numerous clients facing potential discipline of a professional license.
  • Defense verdict in 5-day trial alleging false arrest and damages of over $1million.
  • Lead counsel in defending multiple constitutional challenges to Indiana statute, including Indiana Code § 32-30-6-9 (Right to Farm Act), Indiana Code § 3-5-2-30, and Indiana Code §§ 3-5-9 et seq.
