Shana DeMooy presented “Won’t You Be My Agent?: Breach of Fiduciary Duty Claims in the Probate World.” The presentation covered fiduciary duties owed by executors/administrators, trustees, guardians, and agents under a power-of-attorney, grounds for removal and potential liability for breaches of duty in each context, and case examples from each context. The presentation concluded with best practices for those serving as fiduciaries and the attorneys serving as their counsel.
