Reminger Obtains Defense Verdict in $28 Million Dollar Medical Malpractice Case
In a week-long medical malpractice trial, Attorney William (Bill) Meadows — the Chair of Reminger’s Medical Malpractice Group — and Joseph Palcko obtained a defense verdict for a hospital. The case relates to the placement of the customized stent in a patient, after which the patient’s pulmonary artery ruptured, causing him to exsanguinate and pass away in front of his wife.
In a lawsuit against the hospital, the plaintiff claimed that the hospital’s interventional pulmonologists failed to adequately describe and obtain consent for a bronchoscopy with cautery and placement of a stent to assist the decedent in maintaining his complex and damaged airway following a history of lung cancer, lung removal, and multiple bronchoscopies.
After the plaintiff sought $28 million in damages, the jury returned a defense verdict in favor of our client, finding no breach of the standard of care.
