P. Nicholas Sebastiano presented a live WebCast (1 hour ethics CLE) for the OSBA on “Ethical Considerations with Aging Clientele”. The presentation covered the ethical responsibilities lawyers face when working with aging clients. Topics included:
- How to navigate issues of diminished capacity.
- The role and selection of court-appointed guardians ad litem and legal representatives.
- How to manage conflicts of interest that may arise with current and former clients.
- The ethical implications of lawyers serving as witnesses in matters involving elderly clients. Specifically, in claims of lack of capacity and undue influence. And,
- Responding to subpoenas for the client’s file.
