Reminger Defends Condominium Association Against Breach of Contract and Fiduciary Duty
In a breach of contract and breach of fiduciary duty case against a condominium association and its board of directors, Andrew Dorman and Katie Zorc received a unanimous defense verdict for their clients. Holly Wilson, with the help of (then) Law Clerk Jed Chedid, provided critical research, motion practice, and support to the team.
The case involved six unit owners in an 136 unit Association who accused the Association and its 2015 Board of mismanagement and neglect following the Association’s increase in fees after a costly HVAC system failure. The case was pending since December 2015, with prior appellate proceedings, 11 named parties, and extensive witnesses. After six days of trial, the Cuyahoga County Common Pleas Jury returned a unanimous verdict in favor of Defendants on both claims.
