Overview
Vince focuses his practice primarily in the areas of environmental/mass tort claims and products liability, including OSHA claims. He also practices in the areas of professional liability, employment law, and government/public entity liability. He also has experience in matters of commercial litigation and intellectual property. Vince has extended his practice to include general business consulting.
Vince is admitted to practice law in Ohio, Kentucky and Indiana, in both state and federal courts. He is also admitted to practice in the Sixth Circuit Court of Appeals, the Seventh Circuit Court of Appeals, and the United States Supreme Court. He is a member of numerous professional bar associations in all three states of practice. Vince is a regular presenter at seminars for both legal and human resource professionals relating to professional liability and employment law.

Secured a unanimous defense verdict in a case involving allegations of improper application of bed bug spray.

The case started as a well check of Plaintiff’s children by law enforcement on March 4, 2019, that quickly escalated and lasted for over ten hours. The situation ultimately resulted in Plaintiff’s two children being removed from his home. Attorney Delamater communicated with both Plaintiff and law enforcement officials that day at the request of a friend and in an attempt to de-escalate the situation out of fear for the safety of Plaintiff and his young children. Plaintiff alleged that Delamater did not properly represent him during the subsequent child custody hearings. The Court granted summary judgment in favor of Defendants.

Plaintiff sued our client, a condominium association, along with individual members of the Board, for violations of statutory breach (Ohio’s Condominium Statute), breach of contract, breach of fiduciary duty, and negligence. The claims for statutory breach and negligence were dismissed on summary judgment, and the issues alleged under the breach of contract claim were narrowed. Plaintiff also voluntarily dismissed the claim for negligent infliction prior to trial. After both parties waived the jury trial, the judge issued a thorough decision siding with Defendants on all claims.

We defended housing management company against claim of property damage related to stormwater. We obtained a dismissal based on statute of limitations and failure to prosecute.

Defendant mental health services and housing to individuals with mental health issues. Defendant filed an eviction case against the resident Plaintiff for non-payment of rent. Plaintiff filed a pro se Counterclaim alleging entitlement to the security deposit, as well as alleging property damage and physical injury. Eviction was granted and magistrate dismissed Plaintiff's counterclaim.
