Overview
The defense of non-medical professionals covers a multitude of professions and disciplines.
Our firm has a strong concentration in the areas of Legal Professional Liability, Financial Services Professional Liability, Architects & Engineers/Construction Liability and Miscellaneous Professional Liability. Our depth in these areas accounts for each having a separate subgroup within the umbrella of Professional Liability.
Financial Services Professional Liability
Architects and Engineers / Construction Liability
Miscellaneous Professional Liability
The various professional disciplines represented by our firm not only face claims asserting negligent performance (i.e. malpractice), but also issues of alleged violation of regulatory standards established for many professions, regulated and enforced by various administrative bodies. Thus, the Practice Group members have extensive experience in counseling and representing various professionals faced with regulatory and disciplinary complaints.
Our group is comprised of attorneys throughout our Ohio, Indiana, and Kentucky offices.
Our Services and Philosophy of Case Handling
In collaboration with the client, we aim to immediately assess the different factors that comprise the real 'problem' for the client, and then, after explaining the different scenarios and potential avenues that accompany the issue, we want to decide on the best way to finalize the matter, in as efficient manner as possible. In a word, we strive to be solvers of problems.
While each case will differ based on the facts and the issues presented, but our philosophy is the same no matter what type of issue with which we are presented: We strive to identify the real problem confronting our client, and then to solve it. We know from long experience that this philosophy distinguishes us from so many other law firms, because, all too often, lawyers spin their wheels 'solving' problems that only create larger ones. Our clients can and do expect a different approach from Reminger.

The purchaser of a property who after the title agency prepared the settlement statements instead elected to proceed with the closing without the title agency filed a third-party claim against the title agency when the purchaser later discovered a potentially fraudulent signature in a prior deed in the chain of title. The Court granted the title company summary judgment holding that a title search does not include the rendering of an opinion as to the validity of the title and the title agency was no longer under any independent duty to disburse funds for title insurance that were set forth in the settlement statements when the purchaser elected to forego the closing.

The investigation arose in connection with a nationwide Ponzi scheme that spanned seven years and impacted more than 15,000 individuals, causing several hundred million dollars of losses, and resulting in criminal convictions of a half dozen (non-client) people, including decades of prison time and over a half billion dollars (with a "B") in fines. Joe received notice that the hearing officer agreed that revocation or suspension was not an appropriate sanction for his client, and imposed a fine of just $2,000.

- Jul 6, 2023, Motion to Dismiss Granted with PrejudiceHamilton County Common Pleas Court
Defended a real estate title company in an action for malpractice and professional negligence arising out of an allegedly improper real estate transfer. Plaintiff asserted damages in the six figures for a purported loss in property value arising from the alleged errant transfer. Upon receiving the Complaint, we timely prepared a Motion to Dismiss, arguing Plaintiffs failed to state a claim for malpractice and professional negligence against our client. More specifically, based upon the contract documents attached to Plaintiffs’ Complaint, it was clear from the face of the Complaint that our client was not in privity with the Plaintiffs and owed no duty. Further, under Ohio law, a title company cannot be held liable for legal malpractice. Upon oral argument, the Court ruled from the bench and granted Lawyers Title’s Motion to Dismiss without further delay.

On appeal, the Fourth District Court of Appeals upheld the dismissal.
